Injured Workers’ Advocates Call for Action in Response to National Reporting of Constant Delays and Denials of Medical Care; Inadequate Permanent Disability Compensation; Insurance Carrier Cost-Shifting

SACRAMENTO, CA - The California Applicants’ Attorneys Association (CAAA), whose members represent Californians injured on the job, today responded to a national series of articles by Pro Publica and National Public Radio documenting deplorable delays and denials of medical care, inadequate permanent disability compensation, and cost shifting by workers’ compensation insurers. 

CAAA President Bernardo de la Torre called for action by the Brown Administration to address the “terrible conditions documented in the reporting. Turning down 3.5 million doctors’ recommendations is an avalanche of denials that keeps injured workers from healing and returning to work. Rampant medical treatment denials are harming employers who need productive workers back on the job, as well as injured workers and their families. Insurers and employers are shifting their costs to taxpayers, who end up paying for much of the medical treatment, home health care and disability support.”

“California policy makers can no longer pretend that our system is working well, or that employees injured doing their jobs are receiving the medical care and disability compensation they deserve in return for giving up their right to sue,” said Bernardo de la Torre. “We look forward to hearing how those responsible for running the workers’ compensation insurance system will respond to these reports.”
